Therapy client data GDPR

The following privacy policy sets out the manner in which I use and protect any information that you supply when you either contact me or engage with my consultancy services.

I, being Dr Remy Marckus, am required by law, under the principles set out in the General Data Protection Regulation (GDPR) and by the Information Commission Office (ICO), to inform you as to the ways in which I process and protect any data that relates to you. I am also required to gain your consent to my holding and processing your data in the ways that are detailed below. 

As the Data controller, I am committed to ensuring that I will use the information collected in accordance with all the laws concerning the protection of personal data, including the Data Protection Act 1998 and the GDPR 2016.

Consent

If you agree to give your consent for me to hold and process your data as stated below, please sign and date in the space provided at the bottom of this policy, and return by post or by e-mail to contact@remymarckus.co.uk

In view of the fact that aspects of this policy will be updated when appropriate you are advised to review this information at regular intervals. Changes and clarifications will take immediate effect from the time of posting on this website.

Why I collect data about you

I need to collate information about yourself to enable me to provide you with psychological assessment and relevant treatment. Such information is assembled in order to:

  • Prepare a working contract between us

  • Contact you to arrange appointments and/or discuss payments

  • Request possible feedback on the services provided

  • Comply with the requirements of the following professional governing bodies: the Health and Care Professions Council (HCPC) and the British Psychological Society (BPS)

  • Comply with insurance requirements with regard to the retention of notes concerning our work together

The type of information/data I hold about you

  • Personal Data: basic contact information (name, address, e-mail and contact number, GP and emergency contact details and date of birth). Personal data in respect of invoices, copy receipts, accounting records, tax and VAT returns and related information

  • Sensitive Data: referral information, presenting difficulties and current circumstances. Signed therapy terms and conditions, signed GDPR agreement; therapy records (therapist session notes, letters, reports and/or outcome measures). Relevant medical history, current health conditions and medications.

Information about yourself will be held in the form of emails, invoices, letters, written session notes and questionnaires collected during our association.

How your information/data is stored

Secure arrangements are in place for the storage of all the aforementioned data including written or electronic notes in respect of therapy sessions or telephone calls; and paper or electronic copies of letters and reports. I am the only person who has access to this information with the exception, should I be incapacitated, of a registered named health professional.

How your information/data is shared

All the information that you choose to share with me is strictly confidential. However, the following exceptions apply:

  • Should circumstances or events serve to raise serious concerns about risk to an individual or third parties, I am legally obliged to disclose such data to statutory agencies such as the NHS, Social Services or the Police

  • In the event that I should become incapacitated, my executor will contact a named registered health professional who will be able to contact you and ensure the ongoing security and/or destruction of your data

It is important to note, however, that I have no jurisdiction over any other websites and I cannot therefore be held responsible for the protection and privacy of any information that you may provide to another website. You should exercise caution and study the privacy statement applicable to the website in question.

Retention and disposal of this information/data

Professional and HMRC guidelines recommend that data concerning clients is held for seven years following completion of therapy. Subject to this, all data will be destroyed.

Meanwhile, all reasonable steps will be taken to ensure that personal and sensitive data is regularly updated.

Data/Subject access requests

Individuals have a legal right to request access to their data through a request to myself in person, in writing or by telephone. Such requests, which may require verification of identity, will be responded to within 30 days as per GDPR guidance. It is legally permissible to withhold any personal information that might, if divulged, have serious consequences for an individual’s well-being.

Data security breaches

Should any breaches of your personal data occur, you will be informed as soon as possible by myself, as will the Information Commissioners Office (ICO).
